CALL TO ORDER
Chairperson Barnett called the CDV Committee meeting to order at 6:40 p.m.

Dissolution of Open Space Preservation Committee.

Chairperson Barnett entertained a motion to dissolve the Ad-Hoc Open Space |
Preservation Committee noting that the Committee has done its work and are moving |
forward with the millage proposal, therefore, there is no need for them to report back to |
Community Development and Viability Committee. |
A motion was made by Holder, seconded by Duistermars, that this matter be |
Approved. |
Whereas, the Community Development & Viability Committee (CDV) appointed the |
following to serve on the Ad-Hoc Open Space Preservation Committee at the |
Regular CDV Meeting held March 24, 2005: |
Whereas, the Ad-Hoc Open Space Preservation Committee completed their |
charges and presented their report to the Community Development & Viability |
Committee (CDV) on May 26, 2005, who in turn presented it to City Council on |
June 1, 2005. |
Now Therefore Be It Resolved, that the Community Development & Viability |
Committee dissolve the Ad-Hoc Open Space Preservation Committee. |
Further Be It Resolved, that the Community Development & Viability Committee |
requests that the Clerk's Office send a letter thanking the Ad-Hoc Open Space |
Preservation Committee for their diligent service. |

Discussion regarding Franchise Agreement with Public Utilities.
Roger Rousse, DPS Director, provided an update on the Franchise Agreement with |
Public Utilities. It was noted that the City Attorney is to create a Franchise Agreement |
that gives the City more authority to regulate public utility agencies who are permitted in |
the right-of-way. |

Roger Rousse presented an update on Conservation Easements noting the following: |
* Oakland Land Conservancy has been contacted and are scheduled to meet with the |
Mr. Rousse in September to discuss how they handle encroachments on right-of-ways |
and perhaps form a partnership with the City. |
* Currently our GIS system can determine property lines to within approximately three ( |
3) feet. |
* Gross encroachments can be determined using the GIS system. |
* Determining a small encroachment would require a boundary survey. |
* Oakland County has aerial views. |
Mr. Rousse stated that once encroachment information is obtained the City would need |
to determine what to do. He noted that would cost the City legal fees due to |
corresponding legal costs with boundary surveys. |
Mr. Rousse mentioned and defined a Prescriptive Easement is when a homeowner |
defends or maintains a piece of property and can become owner of that property. |
Mr. Barnett stated that he would look forward to an update at next months Committee |
meeting. |

Mr. Rousse provided an update on Street Lighting Policy and indicated the City Council |
would have to determine if it is interested in adopting the proposed Street Lighting Policy |
that would provide a procedure to follow when a resident requests the City to install a |
street light. |

City Council member Barb Holder inquired of Scott Cope, Director of Building, the status |
of Sign Ordinance amendments. |
Mr. Cope stated that they are waiting on City Attorney and thought that the new |
language may be partially complete. |
