| accommodate the entire parcel, including the portion in the southeast corner of the |
|
| parcel not planned for immediate development. A second detention area will be |
|
| constructed which will drain into the existing pond. Mr. Buckerfield identified the |
|
| proposed "house clearing limits" areas on a display. The individual homes that will be |
|
| built will be unique, architect-designed homes to fit the topography and preserve the |
|
| various stands of trees. The house clearing limits do not coincide precisely with the |
|
| ordinance requirements for every lot. The driveways have been placed to require the |
|
| removal of the fewest number of trees. Although Mr. Buckerfield will only develop |
|
| the land, not build the houses, he intends to provide language in the deed restrictions |
|
| that will control the placement of homes on the lots so that the greatest number of |
|
| trees can be saved. Trees will also need to be removed from the Brewster Road |
|
| right-of-way to accommodate utilities; and most of these trees will be replaced on site |
|
| in the park which is really a storm water detention area, with a few in the boulevard |
|
| area. It would be difficult to find room to replace on site all the trees that are removed |
|
| from individual front, side or rear yards. Therefore, most likely, payments will be |
|
| made into the tree fund. |

| Mr. Rizzardi added a comment to the Staff Report. Trees located in the right-of-way |
|
| of Brewster Road would have to be removed to construct the passing lane for |
|
| southbound traffic. The trees border residential properties on the west side of |
|
| Brewster Road. Mr. Buckerfield is proposing to replace those trees next to the |
|
| passing lane. The 38 regulated trees in the subject right-of-way are city-owned, and |
|
| the city can require a replacement tree for each tree removed regardless of its size. |

| Staff would ask the commission to make a recommendation on this topic also. |
