City Council Members observed a moment of silence in memory of past City Council Member James Rosen.

Administration's Recognition of Council Member Adam Kochenderfer

Vice-President Tisdel announced that Adam Kochenderfer was appointed last Wednesday to fill the Oakland County Commission District 15 seat that was vacated by Jeff Matis' appointment as Circuit Court Judge.  He presented a plaque to Mr. Kochenderfer for his service to the City as Council Member.

Mr. Kochenderfer thanked Vice-President Tisdel and Council.  He expressed gratitude to God, thanked his family for their support; and conveyed his appreciation to Council and to City Staff for their dedication.  He thanked the Mayor for his leadership and friendship.

He noted that of the many things the City can cite as accomplishments and awards, he is most proud of helping a family who had to relocate because of the Tienken Road improvement project.  He explained that they were concerned that their daughter had to change schools, and he noted that he worked with the School Superintendent to ensure that she would be able to stay in her current school.  He commented that government's role should be to cut through red tape and find a solution.  

He stated that tonight is not to say goodbye; it is to say thank you.  He commented that he looks forward to serving the residents on the Oakland County Board of Commissioners.

Dr. Bowyer expressed her congratulations to Mr. Kochenderfer for continuing his public service to the community.  

Mr. Brown commented that he looks forward to continuing to work with Mr. Kochenderfer as he serves on the Oakland County Board of Commissioners.

Ms. Morita stated that while she hates to see Mr. Kochenderfer go, she is excited to see what he will do.  She thanked him for serving; and she noted his efforts as a great family man, always putting his daughter first.

Mr. Wiggins commented that of Mr. Kochenderfer's skills, listening and speaking, have made him very successful.  He noted that Mr. Kochenderfer is a family man, and it will be good to see him stay within the family as he serves Oakland County.

City Clerk Tina Barton expressed her appreciation for Mr. Kochenderfer's constant support from the very day she began at the City.  She commented that it empowers the employees when they know they have individuals like Mr. Kochenderfer on Council representing both staff and their constituents. 

City Attorney John Staran stated that Mr. Kochenderfer's departure will leave a big hole on Council.  He mentioned Mr. Kochenderfer's professional demeanor and ability to calmly and rationally break down and analyze problems and issues, along with his gift and skill to articulate his thoughts in a clear and convincing way.  He stated that Rochester Hills' loss is Oakland County's gain.

Mr. Tisdel commented that it was a pleasure running for election with him.  He 

noted that Mr. Kochenderfer has been a thoughtful, calm and deliberate voice on City Council and will be missed.

Mayor Barnett stated that Mr. Kochenderfer is a gifted public servant who he has known as a friend since he was Student Body President at Oakland University.  He expressed his thanks for Mr. Kochenderfer's service.

Swearing In of Adam Kochenderfer as Oakland County Commissioner, 15th District, by The Honorable Oakland County Circuit Court Judge Jeff Matis

Incoming Circuit Court Judge Jeff Matis administered the Oath of Office to Adam Kochenderfer to the Oakland County Board of Commissioners, for the 15th District.

Community Development Block Grant (CDBG) Program Year 2016 Application

Attachments:

Deborah Hoyle, Financial Analyst, stated that in 2014, the program undertook 53 minor home repairs and serviced 58 low-income seniors.  Haven helped 29 residents, and the Clothes Closet helped 473 individuals.  

She noted that for 2016, funding is proposed to be kept at the same levels, with $10,000 to Yard Services, consisting mainly of snow plowing.  Haven is proposed to receive $7,000, and the Clothes Closet is proposed to receive $10,000.  The remainder of the 2016 funding in the amount of $118,651, will be for minor home repair.

Whereas, Oakland County is preparing an Annual Action Plan to meet application

requirements for the Community Development Block Grant (CDBG) program, and other Community Planning and Development (CPD) programs; and

Whereas, Oakland County has requested CDBG-eligible projects from participating communities for inclusion in the Action Plan; and

Whereas, the City of Rochester Hills has duly advertised and conducted a public hearing on December 7, 2015 for the purpose of receiving public comments regarding the proposed use of Program Year 2016 Community Development Block Grant funds (CDBG) in the approximate amount of $145,651; and

Whereas, the City of Rochester Hills found that the following projects meet the federal objectives of the CDBG program and are prioritized by the community as high priority need.

Therefore, Be It Resolved, that the City of Rochester Hills CDBG application is hereby authorized to be submitted to Oakland County for inclusion in Oakland County’s Annual Action Plan to the U.S. Department of Housing and Urban Development, and that the Mayor is hereby authorized to execute all documents, agreements, or contracts which result from this application to Oakland County.

Joanna Vanraaphorst, 441 S. Livernois, expressed her support for Bill Soule as a replacement for Mr. Kochenderfer on Council.

Mahir Osman, 1730 W. Auburn Road, stated that he serves as Secretary of Public Affairs for the Ahmadiyya Muslim Community.  He expressed his congratulations for those who successfully were elected or re-elected to their positions, and thanked Mr. Kochenderfer and outgoing President Hooper for their extraordinary and exceptional service.  He stated that he wished to reassure the community that the Ahmadiyya Muslim Community believes in humanity and the sanctity of human life and that they are a friend and neighbor and are no threat.  He commented that they stand hand in hand to share resources and stated that only together can injustice be eliminated. 

Gary Uhl, 3508 Wedgewood Drive, expressed his support of Bill Soule to fill Mr. Kochenderfer’s seat on Council.

Peggy Fisher, 3508 Wedgewood Drive, stated that she would also urge Council to consider Bill Soule as a replacement for Mr. Kochenderfer, as he would represent the citizens well.

Pamela Wallace, 168 Cloverport, congratulated Mayor Barnett, Mr. Hetrick and Mr. Tisdel on their re-election.  She requested Council appoint Bill Soule to fill the Council Vacancy.  She remembered Jim Rosen and expressed her condolences on his passing. 

Lee Zendel, 1575 Dutton Road, expressed his condolences on Mr. Rosen’s passing.  He noted that today is the 74th anniversary of the attack on Pearl Harbor.

Mr. Hetrick remembered Mr. Rosen, noting that he had been one of the charter members of the Police and Road Funding Technical Review Committee, and provided a very good hand on the wheel in keeping the committee moving in the right direction.  

Ms. Morita reported that the Oakland County Youth Association held their Sponsor Appreciation Breakfast earlier this week.  She noted that the Avondale Youth Assistance, along with the Auburn Hills Optimist Club, took 30 children from the Matilda Dodge Boys and Girls Club Christmas shopping for presents for their families.  She expressed her appreciation to Mr. Osman and the Ahmadiyya Muslim Youth Association, noting that the organization contributes to the community on a daily basis, helps tutor students and provided manpower at the Youth Dialogue Day.

Mr. Wiggins noted that his prayers go out to Mr. Rosen and his family.  He stated that he was a great public servant, with 15 years on the Planning Commission and two terms on City Council.

Vice President Tisdel stated that he has worked with Mr. Osman on a number of occasions and appreciates the Youth Association's service.  He mentioned that he had the privilege of serving with Mr. Rosen in his first two years on Council; and he stated that he was always generous with his time, experience and knowledge.

City Clerk Tina Barton stated that Mr. Rosen was always a gentleman; and commented that even once off Council, he would come in to the office to visit.

City Attorney John Staran stated that he had known Mr. Rosen during his long time on the Planning Commission and two terms on Council.  He commented that he was always well-prepared.  He stated that even when Council disagreed on something, his goal was to do things for the betterment of the City.

Mayor Barnett stated that he was fortunate to serve with Mr. Rosen both as a Council Person and in his current role as Mayor.  He stated that his fingerprints are all over most of the City's five-year plans and documents, and he noted that he had been Mayor Pro-Tem after the resignation of Mayor Somerville.  He expressed condolences to Mr. Rosen's wife, Kathy and his family.

He echoed the sentiments on the Ahmadiyya Muslim Community and stated that as an organization they should be extremely proud of their efforts to reach out to the community.  

He mentioned the following events:

-  The Christmas Lighting at the Village was held in November.

-  City employees once again undertook Thirty Days of Giving in November, with the goal of every employee giving 30 minutes of their time to help a nonprofit.

-  The Rochester Hometown Christmas Parade was held yesterday, and the 

weather was beautiful.

-  Ribbon Cutting Events were held at the new location for Rockin' Cupcakes and at Einstein Bagels.

-  Meadow Brook Hall is once again hosting its Christmas Walk.  

-  Meadow Brook Theatre has performances of A Christmas Carol throughout December.

-  The Rochester Hills Museum at Van Hoosen Farm has its Model Train Exhibit through January 2, 2016.  The Museum is open 1:00 p.m. to 4:00 p.m.

-  The Environmental Education Center is hosting a Starry Starry Night skywatching event on December 28, 2015.

-  The Museum is hosting its Olde Fashioned Christmas on December 19, 2016.

Request for Purchase Authorization - FIRE:  Purchase of Self Contained Breathing Apparatus and associated equipment in the amount of $758,462.00; Argus-Hazco, Chesterfield, MI

Attachments:

Sean Canto, Chief of Fire and Emergency Services, noted that the Self Contained Breathing Apparatus equipment protects firefighters and allow them to enter certain hazardous environments.  He noted that these proposed replacement units have a life expectancy of ten years.  He pointed out that the bid is $41,000 under budget.

Mr. Brown noted that the Bid Tabulation shows three vendors, with only one bid received.

Chief Canto responded that other contracts were reviewed on the Michigan Intergovernmental Trade Network (MITN) to ensure that the City was receiving the best pricing possible.

Resolved, that the Rochester Hills City Council authorizes the purchase of self contained breathing apparatus and associated equipment to Argus-Hazco, Chesterfield, Michigan in the amount of $758,462.00.

Request for Purchase Authorization - FIRE:  Purchase Authorization for one (1) 95' Platform apparatus in the amount of $1,024,948.81, one (1) 75' Quint apparatus in the amount of $698,572.34, one (1) Pumper in the amount of $437,245.68 and refurbishment of one (1) E-One Rescue in the amount of $278,959.51 with a 5% project contingency in the amount of $127,979.12 for a total purchase not-to-exceed amount of $2,567,705.46; Halt Fire Incorporated, Wixom, MI

Sean Canto, Chief of Fire and Emergency Services, noted that the project as proposed is $79,584 under budget.  He stated that a collaborative purchasing process was utilized, working with Washington Township and Troy.  He commented that the goal is to standardize the vehicle fleet.  He pointed out that the two of the pieces of equipment being replaced are 20 years old and one of the manufacturers is no longer in business, making it difficult to obtain parts and leading to significant repair costs.

Mr. Wiggins questioned whether the life expectancy of the proposed apparatus is also 20 years or longer.

Chief Canto responded that a semi-custom build is proposed, with a 20 year life cycle and ten to 15 years for the engine.  He noted that the DPS Department is actively involved to help with maintenance.

President Tisdel expressed his appreciation to Chief Canto and to Keith Sawdon, Director of Finance, for their successful pursuit of securing the equipment under budget and for involving the DPS Maintenance Division.

Request for Purchase Authorization - BLDG/FAC:  Blanket Purchase Order for natural gas for various City owned buildings in the amount of $422,190.00 through December 31, 2018; Consumers Energy, Lansing, MI

Scott Cope, Director of Building and Ordinance Compliance, stated that the City participates in the State of Michigan MiDeal program to lock in a steady rate for the cost of natural gas.

Mr. Tisdel questioned whether the rate, currently at $4.40 per unit, will fall to $3.39 per unit.

Mr. Cope responded that the rate will be determined at a lock-in when the agreement is signed.  He stated that it should be close.

Public Comment:

Mahir Osman, 1730 W. Auburn Road, stated that he used to work in the natural gas industry for an alternative gas supplier, and questioned whether the City has explored alternative suppliers.  He commented that locking in a rate during the winter may not be the best course of action as prices tend to drop around March or April.

Mr. Cope responded that the City has found Constellation Energy to be one of the cheaper options.  He noted that the City has the opportunity to lock in for one, two or three years.

Mr. Tisdel questioned how Constellation Energy is utilized.

Mr. Cope responded that while the City pays Consumers Energy for distribution charges, Constellation Energy is the supplier and is the company that the City locks in the rate with.

Mr. Hetrick questioned whether the City can review the rate annually if signing a three-year deal.

Mr. Cope responded that the Purchasing Division has the option to lock in for one, two or three years, and will evaluate prices based on market history.  He noted that current prices are very favorable.

Mr. Brown suggested that the Purchasing Division consider a 15-month cycle to take a renewal to a more favorable time.

Mr. Cope stated that he would relay this suggestion to the Purchasing Division.

Resolved, that the Rochester Hills City Council hereby authorizes a Blanket Purchase 

Order for natural gas for various City owned buildings in the amount of $422,190.00 to Consumers Energy, Lansing, Michigan through December 31, 2018.

Request for Purchase Authorization - FISCAL:  Blanket Purchase Order for printing and distribution services for the City's Water and Sewer Utility Bills in the amount not-to-exceed $245,000.00 for a three-year term; Utilitec, Troy, MI

Attachments:

Keith Sawdon, Director of Finance, stated that the City issued a Request for Proposal in 2012 for the printing and processing of its water and sewer bills.  He explained that at that time, Utilitec was given a two-year contract with a three-year renewal term.  He pointed out that Utilitec was selected at that time as the best qualified and was the only firm that would guarantee their price for the five-year term.  He stated that the Administration would like to exercise the three-year renewal, and commented that the City has been very satisfied with Utilitec.
