| | 5. Wetland Mitigation (Replacement) - The developer is proposing to create 0.6887 |
|
| | acres of wetlands in two areas adjacent to the Dutton Drain. These two |
|
| | mitigation areas are located within the 100-year floodplain, but do not |
|
| | constitute loss of the 100-year floodplain due to the excavations. The |
|
| | purpose of the two wetland mitigation areas is to offset the loss of 0.15725 |
|
| | acres of wetlands, 1,036 linear feet of wetland buffer, and the impact on |
|
| | 0.764 acres of 100-year floodplain. The location of the mitigation areas is |
|
| | most appropriate, as these areas will derive excess water from the Dutton |
|
| | Drain when that county drain overflows. The size is most sufficient, and |
|
| | includes mitigation for impacts on the 100-year floodplain. |
|
| | 6. Wetland/Floodplain Easement - This wetland/floodplain easement appears to be |
|
| | very restrictive, and probably unrealistic in the long view. The placement of |
|
| | the easement as indicated on Site Plan - Version 1, by Kieft Engineering, |
|
| | which was revised 2-2-99, seems too restrictive on the rear yards of Lots #2, |
|
| | 3, 6, 7, 12, 14, 15, 16, 17, and 18. The restriction in the rear yards is most |
|
| | severe on Lots #2, 3, 7, 14, 17 and 18. Expanding this easement to 35 feet in |
|
| | the rear yards seems most reasonable, and represents a minimum distance |
|
| | which has been employed by the City of Rochester Hills on other |
|
| | developments. However, if the easement in the rear yard of Lot #14 is |
|
| | extended, the 25-foot wetland setback would be completely eliminated along |
|
| | with some wetland. Also, in order to prevent future easement encroachment, |
|
| | a wooden fence or some other physical device in the field may be necessary |
|
| | on the individual lots. |
