spirit of the ordinance. He said they listened very closely to the suggestions |

of the Planning Commission at the 9-7-93 meeting. He said that the 25' |
|
buffer zone was not required at the time they built the original King Centre. |
|
This imposed some practical difficulty and they investigated the spirit of the |
|
ordinance and what it was intended to do. He believes that the plan before |
|
them this evening, not only meets the spirit of the ordinance, but exceeds |
|
the intent of the ordinance. They don't disagree with the ordinance, |
|
however, in their particular case, their building and what it abuts is a little |
|
different than residential (R-1, 2, 3, & 4). They abut an apartment complex, |
|
which, by semantics, is residential, however, it's location and functionality to |
|
their property is different in the sense that their building has four sides, none |
|
of which is a rear side. He said that, in reading the ordinance, it's his |
|
understanding that the spirit of the ordinance was to help the residential |
|
property that abuts commercial properties that are not so attractive on the |
|
rear sides, such as strip malls, shopping centers, etc. He said that their |
|
building is designed to have four fronts because they will be an office |
|
complex and will require attractive entrances for all of their tenants. |

He presented an enlargement of the new plan showing the placement of the |
|
additional islands across the back, the elimination of the sidewalk |
|
continuing around, and a significant amount of shrubbery and trees. They |
|
have also relocated the trash dumpster to a more desirous area, and is |
|
probably double the distance from the apartments. The other area of |
|
concern was the height of the wall. They are not opposed to the ordinance |
|
requirement of a 6' wall and they built a 6' double-faced wall at King Center |
|
Phase I and II and it's also what they are proposing for Phase III. |
|
Mr. King showed a sketch of what the apartment residents would see from |
|
their balconies. The closest apartment to them is in excess of 140' from |
|
their property line. From the balcony, the tenant would have to make a 180 |
|
degree turn to see the King Centre Office Building. He pointed out that if |
|
the second story tenants looked out over the 6' wall, the 25' berm area |
|
would not be seen. From the lower level apartments, they would just see |
|
the 6' wall. Most of these views are blocked by carports. The berm on the |
|
office property will be nice for the office tenants but not enjoyed that much |
|
by the apartment tenants, however they still wish to do it because the |
|
Planning Commission has requested it. |
