| criteria of the Zoning Ordinance as stated. He said an ordinance change |

| that would permit this use would probably have an impact on a number of |
|
| other sites. He said if they consider changing the language to require two |
|
| major thoroughfares as one of the criteria, that would mean that any corner |
|
| in the city becomes subject to it. He felt that it could be possible to change |
|
| the language from "nonresidential zoning" to "nonresidential use." |
|
| However, the difficulty here deals with existing nonconforming uses. For |
|
| example, if it's a nonconforming business type situation on residential |
|
| property, do you allow the nonconforming use to change a residential parcel |
|
| next to it into another business. He said they could also change the criteria |
|
| much more substantially than that. He said there's no doubt in his mind that |
|
| this parcel has some attractiveness. He said if there was a way to change |
|
| the ordinance to make it easier that also wouldn't open up all kinds of |
|
| possibilities, then that's worth looking at. |

| Ms. Goodwin said if this goes forward to City Council, their response is |
|
| likely to be that it doesn't conform to the Master Plan. If at some point the |
|
| Planning Commission is saying there may be some circumstances which |
|
| only zoning can address, then it would first have to come as part of the |
|
| Master Plan or at least an intent at some point to change the Master Plan in |
|
| a way that the zoning will be consistent. She said it's true that there are |
|
| other properties that would be involved. She commented that the city has |
|
| spent a considerable amount of money defending the zoning on the other |
|
|
