Mr. Rizzardi referred to the updated list of active expiration dates for ZBA cases, and commented that the Board should make a Motion in the matter of File No. 97-045, Barbara Dillon, declaring this issue Moot, since she has been issued the building permit.  There are also three pending cases regarding the commercial vehicle ordinance.  The ordinance amendment has just gone through First Reading at City Council.  These cases will need to come back before the Zoning Board of Appeals.  Also, direction is needed from the Board on how to handle File No. 87-825, Crestview Cadillac.  Crestview’s expiration date for submitting a redesign of their addition was December 8, 1997.  Mr. Rizzardi indicated Staff will write a letter to the applicant informing them that Staff needs a decision on whether the applicant is still pursuing alternatives.  If Staff does not receive a response, the Board can close this file out at the following meeting. 

 

MOTION by Rosen, seconded by Colling, for File No. 97-045, that the request for a variance of 3.46 feet from Table 20.00, Schedule of Regulations of Ordinance 200, to allow the construction of a home at a height of 28.46 feet at 444 Tienken E., be declared MOOT, based on information from staff that a building permit has been issued to the applicant, Ms. Barbara Dillon, 42537 Tessmer, Sterling Heights, MI 48314.
