Body
Resolved that the Rochester Hills City Council hereby denies a variance from the requirements of Section 126-399 of Chapter 126, Article III, Tree Conservation, of the Code of Ordinances to permit the installation of 19 five- to six-inch caliper trees on individual lots in lieu of the $76,867.50 payment into the City's Tree Fund for Eddington Woods Subdivision (City File No. 99-006.4), identified as Parcel Nos. 15-23-152-002 and -012.
 
Findings:  
 
1.      There are no special circumstances or conditions affecting the property such that the strict application of the Tree Conservation Ordinance would deprive the applicant of the reasonable use of his land.   
 
2.      The variance is not necessary for the preservation and enjoyment of a substantial property right of the petitioner.  
 
3.      The variance will not further the objectives and policies of the City.
 
Further Resolved that the City Council directs the City Staff to work with the developer to provide the developer with a fair and appropriate credit for larger replacement trees than the Ordinance requires, in order to achieve the objective of replacing as many trees as possible within the development with replacement trees in excess of the minimum size required under the Ordinance.
