Resolved that the Rochester Hills City Council hereby grants a Variance, in accordance with the provisions of Division 2 of the Subdivisions Ordinance, for the construction of sidewalks required by Section 122-268(b)(1)a, Single-Family Residential Sidewalks, for Winkler Mill Village, City File No. 02-024, a ten-lot site condominium development on approximately 7.2 acres, located south of Washington and west of Dequindre, zoned R-1, One Family Residential, based on plans dated received by the Planning Department on September 30, 3003, with the following findings:
 
Findings:
 
1.      There are special circumstances or conditions affecting the property such that the strict application of the Subdivisions Ordinance would deprive the applicant of the reasonable use of his land.
 
2.      The variance is necessary for the preservation and enjoyment of a substantial property right of the petitioner.
 
3.      The granting of the variance will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated.
 
4.      The variance will further the written objectives and policies of the Subdivision Ordinance and the Master Land Use Plan.
