Adoption of Resolution of Necessity Regarding Construction of Austin Drive
 
 
Body
Whereas, present conditions necessitate the construction and extension of Austin Drive from its current terminus to Devondale Road; and
 
Whereas, preliminary engineering plans showing such improvement have been prepared and are now on file in the City Engineer's office, and detailed final plans are being prepared.
 
Therefore, It Is Resolved, that the City of Rochester Hills declares and determines that it is necessary to construct and extend Austin Drive between its current terminus and Devondale Road in the City of Rochester Hills as is more fully described and detailed on the construction plans.
 
It Is Further Resolved, that it is necessary to acquire highway easements over certain parcels of land described and shown in the exhibit attached hereto, with or without the agreement of the owners thereof, for the purpose of constructing and extending Austin Drive, that said highway easements are necessary for the use and benefit of the public, and the City shall make good faith written offers to purchase said property interests.
 
It Is Finally Resolved, that for those property interests the City is unable to acquire through agreement with the owner, the City Administration and City Attorney are authorized to institute condemnation proceedings against the owners and other parties of interest in said private property necessary for the extension and construction of Austin Drive between its current terminus and Devondale Road.
