Request for Approval of Agreement transferring jurisdiction of Old Adams Road and a portion of Forester Ave. from the Board of County Road Commissioners of the County of Oakland to the City of Rochester Hills

Whereas, Forester Avenue from the west right of way line of relocated Adams Road westerly approximately 0.05 miles to the east right of way line of Old Adams Road; Old Adams Road, from the north right of way line of Forester Avenue to the south right of way line of Hamlin Road; and Hamlin Road, from the west townline of the City of Rochester Hills, easterly approximately 0.92 miles to the west right of way line of relocated Adams Road, are under the jurisdiction and control of the Board of County Road Commissioners of the County of Oakland (the “Board”).
Whereas, The Board represents that Hamlin Road, in its current alignment, has been used by the public and maintained by the Board continuously for a period in excess of ten years; and
Whereas, this City Council is desirous of the City obtaining jurisdiction and control over such road; and
Whereas, 1969 PA 296, as amended; MCL 247.851, et seq, provides for the execution of a written agreement in reference to such transfers of jurisdiction.
Now, Therefore, Be It Resolved, that this City Council hereby consents to the transfer of jurisdiction of the subject portions of Forester Avenue, Old Adams Road and Hamlin Road from the Board to the City of Rochester Hills and authorizes the execution of the attached Agreement between the City of Rochester Hills and the Board, which Agreement will identify the effective date of transfer of jurisdiction following final approval by the Board.
The limits and general description of the roads involved are:
- Forester Avenue from the west right of way line of relocated Adams Road westerly approximately 0.05 miles to the east right of way line of Old Adams Road;
